Terms and Conditions of Participation and Attendance

The following document establishes the General Terms and Conditions (hereinafter, the "Terms") governing registration, attendance, participation, and facility use during the Albatross Cup (hereinafter, "The Tournament" or "The Event"), to be held in Guadalajara, Jalisco, Mexico.

The purchase of a registration, the acquisition of a Hospitality pass, or the mere entry into the facilities designated for The Event constitutes the express, irrevocable, and absolute acceptance of these Terms by the player, guest, sponsor, or attendee (hereinafter, the "Participant" or "Attendee"). IF YOU DO NOT AGREE TO THESE TERMS, YOU MUST REFRAIN FROM REGISTERING FOR OR ATTENDING THE EVENT.

1. DEFINITIONS

For the purposes of these Terms, the following definitions shall apply:

  • Organizing Committee: The group of directors, marshals, and authorized personnel responsible for the execution and logistics of the Albatross Cup.
  • Player: A natural person duly registered and confirmed to actively participate in the golf competition under the established format.
  • Hospitality Guest: An attendee with exclusive access to social areas, lounges, and closing events (19th Hole, Awards Dinner), with no playing privileges on the course.
  • Official Venue: The private golf club and its annexed facilities (parking lots, clubhouse, golf course) where The Event will take place.

2. REGISTRATION, ELIGIBILITY, AND RIGHT OF ADMISSION

2.1. Age and Eligibility: The minimum age to participate as a Player will be established in the official announcement of each edition. For Hospitality passes, minors are permitted entry strictly under the absolute supervision and responsibility of an adult guardian. Access to and consumption of alcoholic beverages is strictly limited to individuals aged 18 and older, requiring official government-issued identification at all times.

2.2. Acquisition Limits: To preserve the exclusivity of the event, the purchase of registrations or passes is limited to a maximum of four (4) per natural person and eight (8) per corporate sponsor, unless express written authorization is granted by the Organizing Committee.

2.3. Right of Admission: The Albatross Cup is a private event. The Organizing Committee reserves the absolute and unappealable right of admission and permanence. Registration or entry may be denied to any individual with a history of indiscipline, prior violations of rules at previous events or the Official Venue, or whose presence is deemed detrimental to the values and exclusivity of the Tournament.

3. PAYMENT POLICY, PRICING, AND BILLING

3.1. Official Payment Methods: Payments will only be recognized if made via bank transfer to the official accounts published exclusively on our official communication channels. The Tournament is not responsible for payments made to third parties, unauthorized brokers, or unverified accounts.

3.2. Pricing and Taxes: All communicated prices, quotes, and registration fees are expressed excluding Value Added Tax (VAT). Prices are subject to change without prior notice before the formalization of payment. It is the Participant's obligation to confirm the validity of the rates prior to their transfer.

3.3. Chargebacks and Disputes: Any attempt to initiate an unjustified credit card chargeback following the event, whether the Participant attended or failed to comply with the cancellation policy, will be considered fraudulent, and The Tournament will initiate corresponding legal and commercial actions.

4. CANCELLATIONS, REFUNDS, AND TRANSFERS

In adherence to commercial fairness and consumer protection, the following strict policies are established:

4.1. Participant Cancellation Refunds:

  • Cancellations notified in writing thirty (30) calendar days or more prior to the event date: 100% refund of the amount paid (minus applicable banking fees).
  • Cancellations notified between twenty-nine (29) and fifteen (15) calendar days prior to the event: 50% refund of the amount paid.
  • Cancellations fourteen (14) days or less prior to the event: No refunds will be issued under any circumstances (0%), due to irretrievable commitments regarding logistics, catering, caddies, and amenities already procured.

4.2. No-Shows: A Participant who fails to appear on the day of the event will forfeit 100% of their registration. Tickets and access passes are non-cumulative and invalid for future editions.

4.3. Substitutions and Transfers: Registrations are transferable without financial penalty provided the original Player notifies and authorizes the change in writing to the Organizing Committee prior to the opening of doors on the day of the event (before the use of the practice facilities). The substitute player must sign the legal waivers and present official identification at registration.

5. EVENT ACCESS AND WRISTBAND CONTROL

5.1. Mandatory Use: At the registration area, each Attendee will receive a non-transferable, categorized identification wristband (Player, Adult Hospitality, Minor Hospitality). The wristband must remain worn and visible at all times.

5.2. Prohibition of Exchange: It is strictly prohibited to remove, alter, transfer, or "lend" the wristband to third parties. Any suspicion of exchange will authorize Albatross Cup personnel to request official identification.

5.3. Penalties: If the lending or counterfeiting of wristbands is proven, all involved individuals will be immediately expelled from the premises, forfeiting any right to a refund, and will be permanently banned from future editions of the Albatross Cup.

6. COMPETITION RULES AND CONDUCT

6.1. Integrity of the Game and Devices: The Tournament promotes an environment of honorability. The use of rangefinders or other distance-measuring devices is strictly prohibited. Falsification of scorecards, cheating, or manipulation of results will lead to immediate disqualification of the team without the right to a refund and an institutional ban.

6.2. Pace of Play: Players are required to follow the instructions of the Marshals and course officials. Failure to comply with instructions to expedite play, following an initial warning, may result in stroke penalties or removal from the current hole.

6.3. Judges and Special Prizes: The decisions of the Organizing Committee, course Judges, and insurance supervisors (in the case of Hole-in-One prizes) are final, conclusive, and unappealable.

6.4. Dress Code: Appropriate golf attire (polo-style shirts, dress/golf pants, or shorts) is mandatory. The use of athletic shorts, denim, collarless shirts, or sandals is strictly prohibited on the course.

6.5. Caddie Policy: The introduction of external or private caddies is prohibited. The Tournament will provide this service. Exceptions will only be considered via formal request submitted five (5) business days in advance, subject to evaluation and written approval by the Organizing Committee.

6.6. Guest Transit: For strict safety reasons, Hospitality guests are strictly prohibited from walking, circulating, or entering fairways, bunkers, and greens. They may briefly access designated areas for photography solely under the escort and permission of Tournament personnel.

7. FACILITY USE AND PROPERTY LIABILITY

7.1. Golf Carts: The Player assigned and handed a golf cart will sign a usage agreement on-site, assuming 100% civil and patrimonial responsibility for any collision, damage, rollover, or misuse of the vehicle during the event. In the event of an accident, the Player must cover the payment of the insurance deductible or the total cost of repair as determined by the provider.

7.2. Food, Beverages, and Substances: The introduction of empty coolers and sealed snacks is permitted. The introduction of external alcoholic beverages is strictly prohibited.

7.3. Zero Tolerance Policy: The consumption, possession, or distribution of illegal drugs or unprescribed controlled substances will result in immediate expulsion, intervention by competent authorities, and a lifetime ban.

7.4. Vehicles and Parking: Vehicles must be parked exclusively in designated areas. The Tournament is not responsible for vehicles towed at the request of the Official Venue if they block access or violate internal regulations, with any generated expenses being the total responsibility of the owner.

8. MEDICAL AND CIVIL LIABILITY WAIVER

8.1. Inherent Risks of Golf: The Participant acknowledges that golf involves physical risks. The Player assumes total civil and medical liability for any bodily or material harm caused to other players, caddies, spectators, or properties by an errant shot, and is required to issue the international safety alert ("FORE!") in case of risk.

8.2. Medical Attention: The Tournament will have paramedics and an ambulance on-site for emergency first response. However, any hospital transfer, medical intervention, or treatment will be at the sole cost and risk of the Participant or their major medical insurance.

8.3. Alcohol Consumption: The consumption of alcoholic beverages during The Event is the absolute responsibility of each adult individual. The Tournament disclaims any incident, traffic accident, or legal infraction arising from alcohol consumption. Although The Tournament may assist in requesting transportation (taxi/rideshare), it assumes no responsibility for said service.

8.4. Valuables: Neither the Albatross Cup nor the Official Venue are responsible for the theft, loss, damage, or misplacement of golf clubs, equipment, electronic devices, wallets, or valuables left in golf carts, lockers, or common areas.

8.5. Liability Waiver: It is an indispensable requirement that all Attendees physically sign the liability waiver document at the time of registration.

9. PRIVACY, LIKENESS, AND INTELLECTUAL PROPERTY

9.1. Image Rights: By entering The Event, the Attendee grants the Albatross Cup the irrevocable, perpetual, and uncompensated right to capture, record, publish, and utilize their image, voice, and name in photographs, videos, and promotional materials in any worldwide media. Exceptions for strict personal security reasons must be managed in advance with the Organizing Committee.

9.2. Personal Recordings: The use of mobile phones and personal cameras for strictly private use is permitted, provided the pace of play and the privacy of third parties are respected at all times. The use of personal drones, as well as livestreaming for commercial or personal monetization purposes, is prohibited without express authorization.

9.3. Intellectual Property and Ambush Marketing: The logos, institutional typography, web design, and trademarks of the Albatross Cup are protected by law. Unauthorized advertising, distribution of flyers, or brand activation by attendees who are not Official Sponsors (Ambush Marketing) is strictly prohibited. Violators will be removed from the event. The Tournament is not responsible for dynamics or offers made independently by Sponsors at their stands.

10. FORCE MAJEURE AND JURISDICTION

10.1. Force Majeure: In the event that The Event must be canceled, postponed, or suspended due to extreme weather conditions (e.g., thunderstorms), natural disasters, pandemics, government emergencies, or causes of force majeure, The Tournament will offer a refund of the registration cost or the transfer of the spot to the newly rescheduled date, without incurring the payment of additional indemnities for travel or accommodation expenses of the Participant.

10.2. Modifications: The Tournament reserves the right to modify, update, or amend these Terms at any time to safeguard the integrity of the event. Updates will be published on the official website.

10.3. Legislation and Jurisdiction: For the interpretation, compliance, and execution of these Terms and Conditions, the parties expressly submit to the current laws and the jurisdiction of the competent courts of the city of Guadalajara, State of Jalisco, Mexico, waiving any other jurisdiction that may correspond to them by reason of their present or future domiciles.
